Terms of Service

1. Who We Are

Attencly is a Content Decision Intelligence platform for video creators, available at attencly.com. We help creators make smarter decisions before they post — improving hooks, tittle, validating ideas, diagnosing underperforming videos, and delivering a single CDI score that tells you whether your content is ready to publish. References to "we", "us", and "our" in these Terms refer to Attencly.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

By using the Service, you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

3. Your Account

You need an account to use most features of the Service. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.

If you suspect unauthorized access to your account, notify us immediately at contact@attencly.com. Accounts are personal and may not be shared or transferred.

4. What You Can and Cannot Do

You may use the Service for your own content creation. You agree not to:

• Submit content that is unlawful, harmful, threatening, abusive, or that infringes on another person's rights
• Create multiple accounts to bypass usage limits
• Attempt to access, copy, or extract any part of the Service's underlying systems or data through automated means
• Use the Service to develop a competing product
• Introduce malicious code or attempt to disrupt or degrade the Service
• Violate any applicable local, national, or international laws

We may determine in our reasonable discretion whether a use violates these rules. Violations may result in account suspension or termination.

5. Free Plan

New accounts receive 2 free uses per tool. These are tied to your account and are not replenished. Creating additional accounts to obtain more free uses is a violation of these Terms and may result in all associated accounts being permanently suspended.

We reserve the right to modify or discontinue the free plan at any time with reasonable advance notice.

6. Paid Plans

Premium and Team plans are available by subscription, billed monthly or annually. By subscribing you agree to the following:

• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel at any time; access continues until the end of your current billing period
• Payments are non-refundable except where required by applicable consumer protection law
• We may update pricing with 30 days' written notice to active subscribers
• If a payment fails, we may suspend your access until payment is resolved

Consumers in jurisdictions with mandatory cooling-off or refund rights retain those rights regardless of what these Terms say.

All payments are non-refundable. If you have a billing issue, contact us at contact@attencly.com and we'll do our best to help.

7. Ownership and Content

Our property

The Service — including its design, scoring system, analysis engine, and all content we create — belongs to Attencly. Nothing in these Terms gives you ownership of any part of the Service.

Your content

You own the hook scripts and other content you submit. By submitting content, you give us a limited license to process it in order to provide the Service. We do not share your content with others or use it to train AI models.

You are responsible for ensuring your submissions do not infringe anyone else's rights.

9. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

We make no guarantee that using Attencly will result in specific retention improvements or video performance outcomes. Results depend on many factors outside our control, including your content, delivery, platform algorithms, and audience.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ATTENCLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claim will not exceed the greater of: (a) the amount you paid us in the 12 months before the claim, or (b) USD $10.

These limitations do not apply where prohibited by law, or in cases of fraud, gross negligence, or wilful misconduct on our part.

11. Indemnification

You agree to defend and hold harmless Attencly and its team from any claims, losses, or expenses — including reasonable legal fees — arising from your use of the Service, your submitted content, or your violation of these Terms or any applicable law.

12. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. We will make reasonable efforts to notify you unless doing so would be harmful or legally prohibited.

You may close your account at any time by contacting us. Your data will be deleted within 30 days as described in our Privacy Policy. Sections 7, 9, 10, 11, and 13 survive termination.

13. Governing Law

These Terms are governed by the laws of India. If you are a consumer in the EU or another jurisdiction with mandatory consumer protections, you also benefit from the laws of your country of residence — those protections are not waived by these Terms.

We encourage you to reach out to us directly first to resolve any dispute. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and notify you by email or through the Service. Continuing to use the Service after changes take effect means you accept the revised Terms.
